Joint Enterprise: What you need to know

The law is clear and unforgiving - if your presence, knowledge or actions lead to a serious crime such as murder you too could be charged with murder.

This is referred to in law as 'joint enterprise'.

This means that it's not just the person who uses the knife or gun that could be charged with murder.It could be anyone who was with them, or knew or did something which led to it happening.

If you weren't charged with murder, you could be charged with other offences, such as aiding and abetting.

Joint enterprise is not a law itself, but means that all those involved in a serious crime such as murder can be charged with the main offence regardless of their role.

What would happen if I was charged with murder?
You could serve a life sentence if found guilty of murder. If you carry a knife you could go to prison for up to four years. If you carry a gun you could go to prison for up to five years.

How do I avoid the risk of being charged under joint enterprise?
Think about who you are with and what they are planning to do.

The advice is simple: Don't carry weapons, know who your friends are and make positive decisions.

Remember:
Company - think about who you are with
Choices - it is up to you to make the right choice
Consequences - if you stay involved with something that leads to a serious crime, you could be arrested and charged
